Intellectual Property Registration in OMAN

Information

Membership: WIPO, Paris Convention, TRIPS and Madrid Agreement;

Classification: 10th Edition of the Nice Classification applies with exceptions;

Coverage: A SEPERATE APPLICATION should be filed for each class;

Rejection: In the Gazette and one local Arabic newspaper;

Publication: In the Gazette;

Opposition: 90 days as from the publication date;

Time Frame: 10 to 14 months from the filing date;

Duration: 10 years as from the filing date;

Renewal: For unlimited periods of 10 years each;

Grace Period: 6 months from the protection’s expiry date;

Penalty: Late renewal penalty is US$350.00;

Assignment: Possible;

Licensing: Possible;

Invalidation: Yes, if the mark has not been used for 5 consecutive years.

Requirements

NEW APPLICATION

a) Power of Attorney legalized to the Consulate of Oman;

b) Certificate of Incorporation legalized to the Consulate of Oman;

c) Applicant’s name, address and nationality;

d) List/s of goods and/or services;

e) Representation of the mark, preferably in jpeg format;

f) If priority is claimed, a certified copy of home application/registration.

*(a) and (b) could be submitted within 60 days after filing the application

RENEWAL

a) Power of Attorney legalized to the Consulate of Oman;

b) A copy of the existing Certificate of Registration.

ASSIGNMENT

a) Power of Attorney legalized to the Consulate of Oman;

b) Certificate of Incorporation legalized to the Consulate of Oman;

c) A legalized Deed of Assignment;

d) A copy of the existing Certificate of Registration.

AMENDMENT

a) Power of Attorney legalized to the Consulate of Oman;

b) A legalized document proving the amendment;

c) A copy of the existing Certificate of Registration.

Charges Details

A) Our charges are TRANSPARENT, so we DO NOT charge for any hidden or sudden costs;

B) Our charges are INCLUSIVE of:

a) Filing, publication and registration fees;

b) Publication in Local Arabic newspapers (min.);

c) Preparing self-adhesive prints;

d) Local legalization of the Power of Attorney;

e) Late filing of the power of attorney;

f) Our professional charges;

g) English translation of the Certificate;

h) Delivery of the Certificate;

i) Translation of up to 100 words of the List/s of Goods/Services (Each additional 50 words or part thereof will be charged for US$50.00).

C) Each additional class filed simultaneously will be subject to a US$50.00 discount;

D) We bill filing charges when the application is filed, while the balance will be billed upon acceptance;

E) Minimum publication in the local newspaper is for 80sq./cm. Each additional sq./cm. will be charged for US$35.00.
